    Terms of Service and Conditions of Sale

    1. Publisher and Legal Information

    The Talk Slower website and application are published by POCLE, a French simplified joint-stock company (Société par Actions Simplifiée) with share capital of 1,500 euros.

    2. Purpose and Scope

    These Terms govern the sale of subscriptions and the use of the "Talk Slower" application. They apply to any subscribing health professional (the "Speech-Language Pathologist" or "Subscriber") as well as to any person granted access through a Pro Code (the "Client"). Using the application constitutes full and unreserved acceptance of these Terms.

    3. IMPORTANT NOTICE (NOT A MEDICAL DEVICE)

    Talk Slower is a tool for voice practice and speech-rate regulation. IT IS NOT A MEDICAL DEVICE.

    • The application provides no diagnosis and no medical prescription. It is intended for informational and self-practice purposes only.
    • Use of the application does not replace professional clinical care and is no substitute for consulting a speech-language pathologist, an ear-nose-and-throat physician, or any other qualified health professional.
    • POCLE accepts no liability for any lack of progress or any worsening of a speech condition. The user is solely responsible for interpreting the data provided (charts, speech rate), which are indicative only.

    4. Services, Access, and Subscription Model

    The application operates under two complementary models:

    4.1 · Professional Model (B2B)

    • The Speech-Language Pathologist takes out a paid subscription and receives a unique "Pro Code" to share with their clients.
    • The Client receives free access to all features (exercises, spectral analysis, progress tracking) using the Pro Code provided by their speech-language pathologist.
    • The Speech-Language Pathologist's subscription includes a set number of "active client accounts" (seats). The Speech-Language Pathologist may archive a client to free up a seat.
    • If the Speech-Language Pathologist cancels their subscription, the associated clients lose access to the exercises and to their tracking data.

    4.2 · Individual Subscription (B2C)

    • Anyone may sign up without a Pro Code and receive a 7-day free trial with access to all features.
    • At the end of the trial, the user may subscribe to a monthly plan at the current rate (currently $9 per month, taxes included, with the first month billed at $1 for a first subscription) to keep access.
    • An individual user may at any time link their account to a speech-language pathologist by entering a Pro Code in Settings, which moves them to the B2B model.
    • If the subscription is not renewed, access to the exercises and to the tracking data is suspended.

    5. Pricing and Payment Terms

    Prices are shown with all applicable taxes included.

    • Professional subscription (B2B): The Speech-Language Pathologist subscribes on a monthly basis. Payment is due immediately upon ordering, and the subscription renews automatically unless canceled before the renewal date.
    • Individual subscription (B2C): A user without a Pro Code may take out a monthly subscription (currently $9 per month, taxes included; first month billed at $1 for a first subscription) after the 7-day free trial. The subscription renews automatically each month.
    • Security: Transactions are processed securely by our PCI-DSS certified payment provider. POCLE does not store any payment card details.

    6. Waiver of the Right of Withdrawal

    For digital content supplied without a physical medium, where performance begins immediately after the user's express prior consent, the user acknowledges that any statutory cancellation or cooling-off period may no longer apply once access to the service has begun.

    By taking out the professional subscription and accessing the features immediately, the Speech-Language Pathologist expressly waives any applicable right of withdrawal.

    7. Personal Data and Health Information

    POCLE places the highest importance on protecting your data.

    • Recordings: Your audio files are not listened to by anyone other than you and, where applicable, the speech-language pathologist linked to your account by Pro Code.
    • Security: Data is encrypted both in transit and at rest.

    8. Liability and Force Majeure

    POCLE shall not be held liable for any internet network failure, software bugs, or hardware incompatibility. In any event, the company's total liability is limited to the amount paid by the customer for the service over the preceding 12 months.

    9. Intellectual Property

    All elements of the application (text, code, audio visualizations, detection algorithms) are the exclusive property of POCLE. Any reproduction or reverse engineering is strictly prohibited.

    10. Governing Law and Disputes

    These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, exclusive jurisdiction is granted to the competent courts within the jurisdiction of the Paris Court of Appeal.
